A notice published in the Federal Register on February 3, 2021 withdrawing one of the last-minute regulations pushed by the Trump Administration. That rule, titled “Discretionary Review by the Secretary of Labor,” was published on January 4, 2021, and would have allowed review of H-2B temporary labor certification cases and to make regulatory changes.
The US Department of Homeland Security and the US Department of Labor jointly withdrew the regulation. The stated reason was due to “significant adverse comment.” This is one of many regulations being stopped, withdrawn, or reconsidered by the new administration under President Biden.
